02. Nature of Platform (Critical Disclaimer)

Samasra Wellness is NOT a healthcare provider, medical practitioner, hospital, clinic, diagnostic center, pharmacy, or insurer.

The platform acts only as a technology and information system and enables:

• Data management and digital record‑keeping.
• Scheduling and communication efficiency.
• Connections between users and third‑party healthcare or wellness professionals.

03. No Liability for Health Outcomes

To the maximum extent permitted under Indian law, Samasra Soft Private Limited shall not be liable for:

• Medical negligence or incorrect diagnosis.
• Treatment plans or adverse health outcomes.
• Delays in care or service delivery.
• Clinical decisions made by healthcare professionals or users.

Any reliance on platform data, reminders, analytics, or communications is solely at the user’s risk. Samasra Wellness does not guarantee accuracy, completeness, or clinical correctness of any health‑related data.

04. User Responsibilities

By using our platform, users agree that:

• They are responsible for the accuracy of data they provide.
• They will consult licensed medical professionals for diagnosis and treatment.
• They will not use the platform as a substitute for professional medical judgment.
• They understand that technology systems may have errors, downtime, or delays.

05. Limitation of Liability

In no event shall Samasra Soft Private Limited be liable for:

Maximum liability, if any, shall be limited to the fees paid to Samasra Wellness in the preceding 12 months, or INR 10,000, whichever is lower.

Samasra Wellness:

• Does not control third‑party services.

• Is not liable for data accuracy provided by third parties.

Use of the platform is subject to the Privacy Policy, which forms an integral part of these Terms. Health and personal data are processed in accordance with:

• Information Technology Act, 2000
• IT (Reasonable Security Practices) Rules, 2011
• Digital Personal Data Protection Act, 2023 (India)

08. Indemnity

Users agree to indemnify and hold harmless Samasra Soft Private Limited from claims arising from:

• Violation of laws or third‑party rights.
• Medical or clinical disputes.
• User‑provided content or data inaccuracies.

09. Termination

Samasra Wellness may suspend or terminate access:

• For violation of terms.

10. Governing Law & Jurisdiction

These Terms shall be governed by the laws of India.

Courts at Tirupati, Andhra Pradesh, shall have exclusive jurisdiction over any disputes.
